        I am an employer getting sued for discrimination; what should I do?

        Answer:

        As a skillful Delaware County Employment Lawyer, I get questions from clients all the time regarding being sued for discrimination as an employer.

        If you are an employer in Pennsylvania, there are certain requirements you must meet regarding treatment of certain classes of employees in the State of Pennsylvania and under federal government regulations.

        Due to federal laws regarding anti-discrimination, when discrimination is alleged, cases often end up in federal court rather than state court.

        The basic principles prevent discrimination based on race, age, or gender. Statutes have been established, including complicated ways in which elements can be proven, and specific remedies have been set forth.

        You might have discrimination in the way that you decide your employee practices, the interview process may be biased towards a certain race or against a certain race, or the manner in which you implement a particular policy may be determined to be discriminatory.

        For example, a person may subconsciously avoid hiring certain minorities. If they implement that policy, they may be held responsible if someone applies and contents that your policy is discriminatory, or if the company is found to lack enough individuals of a certain race, it may be held to be discriminatory.

        It’s the same way regarding age. There are statutes about age discrimination, which is age 40 and above. The way in which you implement those policies and/or the way you apply the policies can be held to be discriminatory and you can be held responsible.

        The same thing is true with regards to gender. If you violate the policy, the provision in the law allows that an individual can bring a claim against you. Discrimination may be determined by factors such as compensation, lost wages, loss of an opportunity, or if you decide to terminate someone because of age discrimination or gender.

        Those charged with discrimination may be liable for compensation of lost wages, potentially some pain and suffering on a limited basis, and generally are also responsible for legal counsel fees in pursuing the claim.
