        If you have long-term employee who is no longer performing the functions of his or her job, you can terminate them. However, you should also be aware that these are fertile grounds for a potential age-based discrimination suit.

        Leading up to the decision to terminate, you and your HR department should make sure that you document or provide notice to the employee that the quality of work is falling below what is required. You will also need to give the employee the opportunity to correct those shortcomings. In the absence of the employee correcting their shortcomings, you’ve established the groundwork and the basis for your non-discriminatory decision and you can terminate.
