If a document was notarized by a notary whose commission has expired, how does that effect the validity of the document?

Answer:

As an experienced Delaware County Estate Planning Attorney, I often handle theses types of matters. New York wills are not required to be notarized, rather it requires the signature of 2 witnesses. So long as 2 people witnessed the will, the fact that the commission was expired should be of no effect. Generally, if a notary’s commission has expired, it does not mean that the document itself is invalid, it just means that the notarization of the signature is faulty.
