What Questions Can an Employer Ask Under the Americans with Disabilities Act?
Our experienced Media Employment Lawyers are committed to providing sophisticated solutions for a wide range of employment matters.
We are often asked as Media Employment Lawyers about what questions can be asked to employees in regards to disabilities under the Americans with Disabilities Act.
- You cannot outright ask an employee if they have a disability. You can ask if they will be able to perform their job duties without reasonable accommodation, if they openly disclose that they have a disability.
- If you find out that an employee has a disability later on, you can only ask about that specific disability and how it effects the job. You can also request a medical examination if the employee is unable to perform those duties because of the disability.
