Delaware Legal Malpractice Attorney Discusses Being Forced to Settle
A lot of people ask me as a Delaware Legal Malpractice Attorney, “Can my lawyer make me settle a case”? No, the client is the person who makes the final decisions. The client is the captain of the ship. Lawyers, are the navigators. We give the best advice we can, as to what path to go down and then it is the client that makes the decision.
There are problematic clients. As an attorney, you know that you’ve just recommended the best deal this client is going to get and if they walk away from it, they’re going to make a big mistake. I’ve even had clients say, “I don’t care”.
As a Delaware Legal Malpractice Attorney, I protect myself in that kind of a situation by using a fee agreement. It says that if I have a belief that you need to settle a case for “x” amount of dollars and you don’t, then I have the right to withdraw my representation. You can’t continue to press a case if you know in the end it’s going to not be a good deal for the client. However, if I withdraw and the client seeks out another lawyer and accepts a settlement of $1,000 more than I recommended, my agreement says I get my full fee.
